Challenges and Solutions for Physical Land Ownership Proof Issues in Indonesia

In the process of land ownership across various regions in Indonesia, physical proof often becomes a vital foundation. However, in several cases, village heads do not always handle the physical land ownership proof seriously. This problem often arises due to the pressure to complete the process quickly, ignoring the rights that should be granted to the rightful parties.

Land ownership proof is often based only on the testimony of two witnesses who do not have vertical and horizontal relationships up to the second level. However, on the ground, especially in Eastern Indonesia, land ownership is often not supported by clear evidence. This results in the rightful parties only being able to prepare proof of ownership without the village head's official endorsement.

Without the official support of the village head, this ownership proof becomes vulnerable and raises questions about who is responsible if problems arise in the future. This issue needs to be addressed by village heads to ensure that the land ownership process can proceed more fairly and transparently.

In some areas in Java, the land ownership process may be more structured and organized, so such risks are less frequent. However, challenges still exist, and it is important for all involved parties to ensure that land ownership rights are recognized and protected properly.
